MEDIA DESIGN AND PRINT TERMS AND CONDITIONS

In placing an order on the Media Design and Print website, you agree to be legally bound by the following Terms and Conditions. Media Design and Print reserves the right to modify these Terms and Conditions of Business; it is your responsibility to review them periodically.

1. DEFINITIONS

1.1 “Seller” means Media Design and Print VAT No: GB 454 6897 00 whose registered office is at Unit B7, Portview Trade Centre, 310 Newtownards Road, Belfast BT4 1HE.

1.2 “Buyer” means the person or entity placing an order.

1.3 “Contract” means the Order and Order Confirmation (incorporating any Special Conditions).

1.4 “Faulty” means containing a fault or defect.

1.5 “Goods” means the goods sold by the Seller under these Terms and Conditions.

1.6 “Order” means the Buyer’s order for Goods.

1.7 “Order Confirmation” means the Seller’s confirmation pursuant to Condition 4.2.

1.8 “Price” means the price together with postage and packing in force at the date and time of the Order.

1.9 “Special Conditions” means any conditions in relation to Orders set out and designated as such in the Order Confirmation.

1.10 “Terms and Conditions of Business” means these standard terms and conditions of business.

2. INTERPRETATION

2.1 Headings in these Terms and Conditions are for convenience only and shall not affect their interpretation.

2.2 A reference to a statute includes any amendments, extensions, or re-enactments thereof.

2.3 A reference to writing or written includes email correspondence sent to printing@mediadesignandprint.com.

3. APPLICATION OF TERMS AND CONDITIONS

3.1 These Terms and Conditions govern the Contract exclusively, superseding any other terms unless agreed in writing by the Seller.

3.2 Employees of the Seller are not authorised to make representations regarding the Goods unless confirmed in writing.

4. ORDERS AND SPECIFICATIONS

4.1 All Goods are subject to availability and the Seller’s acceptance of the Order.

4.2 The Seller reserves the right to reject any Order at its discretion.

4.3 Product specifications may change due to ongoing product developments. Goods may vary slightly due to differences between screen colour (RGB) and print colour (CMYK).

4.4 The Seller makes every effort to display product colours accurately but cannot guarantee an exact match to those displayed on the Buyer’s monitor.

5. PAYMENT

5.1 All Prices exclude UK VAT. VAT will be added where applicable. Buyers outside the UK are responsible for any applicable taxes or duties in their jurisdiction.

5.2 Payment must be made at the time of Order, unless otherwise agreed.

5.3 The Buyer confirms that the payment method used is valid and authorised for the transaction.

6. DELIVERY

6.1 Goods will be delivered to the address specified in the Order unless collection from the Seller’s premises is requested.

6.2 Delivery times are estimates only and the Seller is not liable for delays beyond its control.

6.3 The Buyer must inspect Goods upon delivery and report any damage or defects within 14 days, providing photographic evidence where possible.

6.4 The Seller may deliver Goods in instalments.

6.5 Risk in the Goods passes to the Buyer upon delivery, except for consumer sales, where risk remains with the Seller until the Buyer receives the Goods.

6.6 Returns are governed by Condition 8 below.

7. RISK AND PROPERTY

7.1 Risk of loss or damage to the Goods passes to the Buyer upon delivery.

7.2 Legal ownership of the Goods remains with the Seller until full payment is received.

8. REFUNDS AND RETURNS

8.1 The Buyer may cancel an Order in the following circumstances:

If the Seller fails to deliver within 18 days of the Order.
If the Goods are Faulty, provided the defect is reported within 14 days of receipt.

8.2 Cancellations must be made via email to printing@mediadesignandprint.com.

8.3 Goods made to Buyer specifications or personalised items are non-refundable, unless Faulty.

8.4 If an Order is cancelled due to Seller error or Faulty Goods, the Seller will refund all sums paid, including any delivery charges.

8.5 Returned Goods must be in their original packaging.

9. LIMITATION OF LIABILITY

9.1 The Seller’s total liability shall be limited to the amount paid for the Goods.

9.2 The Seller shall not be liable for indirect or consequential losses, including but not limited to:

Loss of profits or business
Loss of contracts or goodwill
Loss or corruption of data

9.3 Nothing in these Terms and Conditions excludes liability for fraud or personal injury caused by negligence.

10. INTELLECTUAL PROPERTY

10.1 The Seller owns all copyright in mediadesignandprint.com content.

10.2 The Buyer retains ownership of any intellectual property in designs they provide but warrants that they have the right to use such designs.

10.3 The Seller reserves the right to refuse Orders suspected of infringing third-party intellectual property rights.

11. EXCEPTIONAL CIRCUMSTANCES

11.1 The Seller may cancel or delay Orders due to circumstances beyond its control, such as supply chain disruptions or regulatory changes.

11.2 If delays exceed 14 days, the Buyer may cancel the Order and receive a refund.

12. CONSUMER RIGHTS

12.1 Nothing in these Terms and Conditions affects consumer rights under UK law, including rights under the Consumer Rights Act 2015.

13. THIRD-PARTY RIGHTS

13.1 No third party shall have rights to enforce any part of this Contract under the Contracts (Rights of Third Parties) Act 1999.

14. GENERAL

14.1 The Seller strives to maintain website availability but is not liable for interruptions beyond its control.

14.2 Product descriptions are provided in good faith but may contain occasional errors.

14.3 The Seller is not responsible for third-party website content linked from mediadesignandprint.com.

15. GOVERNING LAW AND JURISDICTION

15.1 These Terms and Conditions are governed by Northern Ireland law.

15.2 Any disputes arising shall be subject to the exclusive jurisdiction of the Northern Ireland Courts.
